Search Clay County Arrest & Criminal Records

Clay County arrest records are made when a person is booked into the county jail by the Sheriff or by another law enforcement agency working in the county. To search for Clay County arrest records, members of the public can use the official Sheriff's detention listings, the statewide court case portal, and request forms held by the Circuit Clerk. Clay County arrest record searches also overlap with criminal records, since each booking can become a court file once charges are filed. Arrests, mugshots, charge data, court dates, and bond entries are all part of the same Clay County arrest records trail.

Arrest Records in Clay County

An arrest record in Clay County is generated at booking. The Clay County Sheriff's Office runs the Clay County Detention Center at 14 S. Water Street, Liberty, and is the main agency that books people into custody. Police from cities like Liberty, Kansas City North, North Kansas City, Excelsior Springs, Smithville, and Gladstone also bring arrests to the detention facility. The arrest log shows the booking date, the charge, race, sex, cell, court date, and the court division.

An arrest record is not the same as a criminal court record. The Sheriff creates the arrest entry at booking. The Circuit Clerk's Criminal Department creates the case file once the prosecutor files charges. Some arrests never become court cases, and some court cases start from a summons rather than a booking. For broader case history, see the Clay County court records page; the arrest side of the trail is the focus here.

Arrest reports in Missouri are open by default. Under RSMo 610.100, incident and arrest reports from a law enforcement agency are public, with a key exception: if the person is not charged within 30 days, that arrest report becomes a closed record. Investigative reports may also be closed while a case is active.

Arrest Record vs. Criminal Court Record

The arrest record lives with the Sheriff. The criminal court record lives with the Circuit Clerk. The two are linked but are not the same file. An arrest record may exist without a court file (if no charges are filed within 30 days). A court file may exist without a fresh booking (if the defendant was summoned to court instead).

Charges vs. Convictions

A charge is not a conviction. A person can be arrested, charged, and still found not guilty or have the case dismissed. The Clay County Criminal Department uses the indictment, information, or complaint as the charging document. A probable cause statement supports the charge. A conviction requires a plea of guilty, a guilty verdict, or a finding by the court after trial.

Use the Case.net disposition line to see how a Clay County case ended. The charge field is the start; the disposition is the answer. Sentences set fines, jail time, probation, restitution, and any other court-ordered terms.

Sealed vs. Expunged Records

Missouri does not draw a bright line between "sealed" and "expunged" the way some states do. Most Missouri orders use the word expungement. RSMo 610.140 allows qualifying people to file a petition to expunge certain arrests, pleas, trials, or convictions. The Missouri Courts expungement page explains that expungement seals or destroys the record so it is not publicly available. Some marijuana-related expungements after Amendment 3 are automatic.

SealedExpunged
VisibilityHidden from the public indexRemoved from public access; viewable only by court order
Law EnforcementLimited internal accessVery limited; some retention for future statutory use
EligibilityStatute-driven; varies by offense and timeRSMo 610.140 lifetime caps: up to 3 misdemeanors, 2 felonies; infractions not capped the same way
SurchargeNone specificFiling surcharge under RSMo 488.650

The Clay County Civil Department lists Expungement / Correction of Arrest Record as a Circuit Civil case type, codes YG and XG. The petition is filed in the court where the offense was charged or where the finding of guilt was entered.

Mugshots and Booking Photos

Booking photos are part of the arrest file. The Clay County detention listings page includes image placeholders next to roster entries, and the Sheriff's records custodian page lists mugshots and detention records under the records fee schedule. The fees are $26 per hour for research plus $0.10 per page. Mugshots are produced as public records to the extent allowed by RSMo 610.100.

Once an arrest crosses the 30-day no-charge line, that arrest report becomes a closed record. The mugshot tied to a closed arrest may also drop off public listings. For Most Wanted entries, see the Clay County warrant records page, which uses photos drawn from prior bookings and Sheriff files.

How to Request a Closed Criminal Record

Closed criminal records are not open to the public. The Clay County Circuit Clerk's Criminal Department limits closed records to the defendant, the attorney of record, and other parties allowed by law. Walk-in requests need valid government ID. Fax requests need more.

  1. Prepare a clear copy of your government-issued photo ID.
  2. Write the full name, date of birth, and last four digits of the SSN of the person on the record.
  3. List the documents being requested and any helpful case identifiers.
  4. Add a return mailing address or fax number, plus a contact phone number.
  5. Sign the request in front of a notary; the Criminal Department requires a notarized signature for fax requests.
  6. Fax the full packet to 816-407-3899.

The Criminal Department page spells out the rule in plain language. Skipping any step delays the response. The clerk acts on requests as soon as possible and no later than the third business day under RSMo 610.023.

Sheriff Records Fees for Arrest Data

The Sheriff's custodian of records page lists fees for incident reports, booking files, and audio or video that may be tied to an arrest. Captain Chris Johnson is the custodian under RSMo 610.023.

ItemFee
Incident report$5 per report, plus $0.10 per page after
Report reproduction research$26 per hour, plus $0.10 per page
Video or audio reproduction$41 per hour
Media device or electronic share$10 each
Mugshot and detention records research$26 per hour, plus $0.10 per page

Detention records from previous or current incarcerations have a separate detention-record email listed on the same page. Court filing fees and expungement surcharges go to the Circuit Clerk, not the Sheriff.

Background Check Considerations

Casual Case.net or roster lookups are not the same as a Fair Credit Reporting Act background check. FCRA-compliant background checks must be ordered through a consumer reporting agency. Employers, landlords, and insurers who use background data for FCRA-regulated purposes must follow strict notice, dispute, and accuracy rules. The Clay County roster and Case.net are public information services, not FCRA reports.

Important: Clay County Court Records is not an FCRA-regulated consumer reporting agency, and information here cannot be used for credit, employment, tenant, or insurance decisions.

Restricted Clay County Arrest Records

Some arrest data is closed by statute. Juvenile arrest records are closed under RSMo 211.321. Mental health holds and Chapter 632 commitments are confidential under RSMo 630.140. Investigative reports may stay closed while a case is active under RSMo 610.100. Arrest reports where the person is not charged within 30 days become closed under the same statute.

Expunged criminal records leave the Case.net public view and the Sheriff's detention archive, but criminal justice agencies may keep limited access for statutory uses. The Court Operating Rule 2 redaction list also strips SSNs, financial accounts, dates of birth, minor names, and protected victim data from public arrest filings.
